These persons, although they may not be prevented from it, lack nonetheless the right of sending or posting information on SmartDrinks.ro, regardless of their nature. Any such operation shall be executed by means of the minor’s legal representative.

The SmartDrinks.ro team independently establishes the regulations of promotions and contests it organizes. These regulations are brought to the attention of any possible participants through the SmartDrinks.ro website or by other means or public or private communication. Promotions will be strictly limited to those orders fully abiding by the rules displayed on SmartDrinks.ro. additionally, promotions apply only to orders which are placed with the company within the time span when the said promotions are valid and only as covered by available stocks. SmartDrinks.ro does not guarantee the stock availability of promotional products and may discontinue or cancel the said promotions at any time, without any prior notice.

 

 

The prices are displayed on the website in lei as follows: LEI (RON), VAT included.

• FREE OF CHARGE – if the value (VAT included) exceeds 149 RON, orders deliverable at a single address;
• The cost of transportation (for orders under 150 RON) is 15 RON;

• For deliveries anywhere else in Romania we have a fixed shipping fee of 15 LEI. Orders will be delivered through Urgent Cargus in 24 - 48H - delivery time available for orders paid by card or for payment upon delivery. For payment through bank transfer, the delivery time is calculated from the moment the bank transfer has reached our bank account.                                     

Orders placed on our website can also be picked up from our warehouse located in Biruintei Blvd. no. 103, Pantelimon city, Ilfov county.

SmartDrinks.ro reserves the right to reject orders and/or deliveries from particular customers and/or to particular addresses.

 

 

The products marketed through SmartDrinks.ro have, in each and every case, the validity term granted by their manufacturer. In no more than 48 hours from the delivery of the product, should any discrepancies be identified as opposed to the manufacturer’s specifications, you may request the return of the product(s), only in its/their original packing and together with the original documents of the respective transaction. In this case, we shall replace the respective item with an identical one or – if this is not possible – you shall be reimbursed the amount paid for that item.

 

 

SmartDrinks.ro guarantees the security and confidentiality of the data hosted and transmitted by means of its informational system. However, SmartDrinks.ro shall not be held liable for the losses of information caused by any malfunctions or errors of the software with which the website is conceived and hosted, nor does it guarantee the fact that the website, the server(s) or the e-mail(s) submitted by SmartDrinks.ro are free of any viruses or other malicious components. In addition to these, SmartDrinks.ro is not liable for malfunctions endangering the security of the server where the website is hosted. SmartDrinks.ro guarantees security and confidentiality in general, but does not guarantee the security or stability of the software.

 

 

The products (as the case may be) are joined by manufacturers’ authenticity / warranty certificates. SmartDrinks.ro shall not be liable in the case of any discrepancies or missing items in relation to the products, their quality or any other aspects regarding these products. Any claim shall be notified to SmartDrinks.ro within no more than 48 hours from receipt of the products, the said claim being subsequently forwarded to the supplier of the respective products for settlement.

 

In cases when the products cannot be delivered or undergo malfunctions during delivery, the customer may request the immediate reimbursement of the amounts already received by SmartDrinks.ro, but not other additional reimbursements, as well.

 

SmartDrinks.ro cannot guarantee the stock availability of all displayed products. For that reason, SmartDrinks.ro reserves the right to refuse to honour a specific order if the respective product is not currently supplied. The customer shall be reimbursed by SmartDrinks.ro with the sums received for the respective order.

 

 

SmartDrinks.ro shall provide users with no guarantees referring to the availability of its services, the correctness of the information publicised or the security of its services.

 

The website content (texts, descriptions of products, technical specifications, images, symbols) is the property of ALMA TIM DISTRIBUTION. The images on the site are strictly for presentation purposes, and the products effectively delivered may differ from the images in any way (colour, accessories, aspect, etc.)

 

The SmartDrinks.ro website and the related materials are provided “as they are” and “within availability limits”.

 

SmartDrinks.ro is neither to be held nor made liable for any damages occurred through the use of any kind of the products purchased by means of this site.

 

SmartDrinks.ro provides no guarantees and shall not be in any way liable if the products purchased fail to correspond to the purpose for which they were purchased.      

 

ALMA TIM DISTRIBUTION / SmartDrinks.ro shall not be liable for any sort of damages including, but without limitation to, any direct, indirect or incidental damages. The company is not liable for any of the customers’ damages, regardless of their nature.

 

 

Any attempt of unauthorised access to SmartDrinks.ro and any fraud attempt shall be without delay reported to the competent authorities. All litigations shall be settled amiably. Should the litigation fail to be settled amiably, it shall find its settlement by resorting to the arbitration of the Court of International Commercial Arbitration attached to the Chamber of Commerce and Industry of Romania and Bucharest Municipality in accordance with the Rules of arbitration procedure of the said Court. Each party shall designate one arbitrator from the list of arbitrators, and the third arbitrator shall be designated by the two arbitrators initially designated by the parties. The arbitration expenses shall be borne by the party which lost the litigation. The arbitration decision is definitive and enforceable. The arbitration decision invested with executory powers represent a writ of execution and shall be forcefully executed in the same way as a court sentence. The force majeure invoked and supported by evidence by one of the parties under the conditions of the law exonerates the parties from obligations – safe for the payment obligation for the services provided prior to its occurrence – over the entire duration of the force majeure.

 

 

The entire content of the SmartDrinks.ro website – images, texts, diagrams, symbols, WEB graphics elements, scripts, applications and other data – is the property ofALMA TIM DISTRIBUTION and is protected by the Copyright law and the laws regarding intellectual and industrial property. The use of any of the elements listed above, without the consent of ALMA TIM DISTRIBUTION, is punishable according to the legislation in force.

 

 

People who access/visit the website may make comments and submit any other communications; they may send e-mails, submit suggestions, ideas, questions or other items of information, as long as their content is not illegal, obscene, threatening, demeaning, does not disturb in any way other persons’ private life, does not infringe intellectual property rights, does not contain viruses, texts concerning various promotion campaigns, chain letters, mass e-mails or any other form of spam. The persons who will use a fake e-mail address or send electronic messages or any other communications on behalf of another physical person or legal entity shall be sanctioned in compliance with the laws in effect. SmartDrinks.ro has the right (however, not the obligation, as well) of erasing any such contents identified on the website.

 

 

ALMA TIM DISTRIBUTION has concluded reseller agreements with major representatives of the brands present in our stores. With regard to product quality, brand authenticity and any other uncertainties related to a specific brand or product, customers may address themselves to the representative of the respective brand or importer / manufacturer in Romania.

 

 

The final price paid by the customer comprises the price of the product(s) and any existing transportation expenses. SmartDrinks.ro does not charge the customer any other additional tax upon the purchase of the product(s), except for the case when the Laws in force might require as such. Final Provisions  

 

Should any of the above clauses be deemed null or invalid, regardless of the grounds, that clause shall not affect the validity of the other clauses. Once the order has been purchased and placed, the customer accepts with no objections the Conditions and Terms, their value being the same as that of a validly concluded agreement.
